DEAD TO DEALS PROGRAM POLICY
Effective Date: 03/01/2025
This policy details X Squared Systems, Inc.'s ("X Squared") Dead to Deals program. X Squared operates the program through its subsidiary Perci, Inc. DBA Rezzy Mortgage (hereinafter referred to as “Rezzy Mortgage” or "Rezzy"). The customer is the Agent (defined as a real estate agent, real estate team, or real estate company) utilizing Rezzy Mortgage’s lead re-engagement services.
1. Purpose and Scope
Rezzy Mortgage provides lead re-engagement services to reconnect with inactive or old leads from the Agent’s database. The objective is to identify homebuyers who may be ready to move forward and return them to the Agent pre-approved or pre-qualified for a mortgage. Rezzy Mortgage may whitelabel its services to act on behalf of the Agent when contacting leads. In these cases, Rezzy Mortgage will communicate as an extension of the Agent’s business, subject to compliance with applicable laws.
2. Rezzy Mortgage’s Sole Discretion Over Lead Management
Once leads are submitted to Rezzy Mortgage, Rezzy Mortgage has sole discretion to facilitate mortgage transactions with those leads.
The Agent may not request or require Rezzy Mortgage to remove submitted leads from its pipeline once they are in the system.
Rezzy Mortgage does not obligate the Agent to submit additional leads, and participation in the program is voluntary.
3. No Guarantee of Conversion
Rezzy Mortgage does not guarantee that re-engaged leads will result in a closed transaction, loan approval, or financial benefit for the Agent. This service creates additional opportunities but does not ensure specific results.
4. Confidentiality and Data Protection
Rezzy Mortgage will treat all leads submitted by the Agent as confidential.
Rezzy Mortgage may share the leads with its affiliates or subsidiaries.
Lead data will not be sold, distributed, or shared with third parties outside the scope of this service.
Rezzy Mortgage processes lead data strictly for re-engagement purposes and to create potential opportunities to originate mortgage loans. Rezzy Mortgage does not claim ownership of any leads submitted by the Agent in regard to the real estate transaction.
5. Lead Exclusivity and Return to Agent
Leads that Rezzy Mortgage successfully re-engages will be returned exclusively to the Agent for follow-up and transaction facilitation.
If a re-engaged lead is located outside the Agent’s service area, it is the Agent’s responsibility to facilitate a referral fee agreement with an out-of-area agent. Rezzy Mortgage will not reassign the lead in these circumstances.
6. Lead Reassignment Conditions
Rezzy Mortgage will only reassign a re-engaged lead to another agent if:
The Agent is no longer in business.
The Agent is no longer affiliated with the company they were with when they originally submitted the lead to Rezzy Mortgage.
In all other cases, the lead will be returned to the original Agent, who may then coordinate a referral with an out-of-area agent as needed.
7. Agent’s Right to Terminate Rezzy’s Contact With Leads
If the Agent is dissatisfied with Rezzy Mortgage’s performance, the Agent may request that Rezzy Mortgage cease contacting leads on its behalf.
However, Rezzy Mortgage retains sole discretion to continue prospecting those leads under its own name.
8. Service Termination and Modifications
This policy applies as long as the Agent is actively utilizing Rezzy Mortgage’s services.
The Agent may terminate participation in the service with 30 days' written notice.
Rezzy Mortgage reserves the right to modify, suspend, or discontinue this service at any time for compliance, operational, or business reasons.
9. Compliance Responsibility
The Agent is responsible for ensuring compliance with all applicable federal, state, and local laws, including but not limited to:
- Fair lending regulations
- Consumer protection laws
- Real estate advertising and referral guidelines
10. Acknowledgment and Agreement
By utilizing Rezzy Mortgage’s lead re-engagement services, the Agent acknowledges and agrees to the terms of this policy.
